1. Acceptance of Terms
By accessing our website or booking services through Nova Vacations, LLC, doing business as Nova Travel Collective (“Company,” “we,” “us,” or “our”), you agree to these Terms and our Privacy Policy. These Terms govern your use of our website and all travel services arranged through us.
2. Our Role as a Travel Advisor
Nova Travel Collective acts solely as an independent travel advisor and agent for third-party travel suppliers (“Suppliers”), including airlines, hotels, cruise lines, and tour operators.
We do not own, operate, or control these Suppliers. All bookings create a direct contractual relationship between you and the Supplier, and their terms apply.
3. Independent Advisor Model
Our advisors operate as independent contractors under the Nova Travel Collective brand. We coordinate services but are not responsible for independent advisor operations outside confirmed bookings.
4. Booking Authority & Responsibility
You represent that you are at least 18 years old and have authority to make bookings for yourself and all travelers in your party. You accept financial responsibility for all bookings and agree that all information provided is accurate.
5. Booking, Payment & Account Responsibility
Bookings are subject to availability and Supplier acceptance. You authorize us to charge your payment method for all confirmed services, including any applicable adjustments due to taxes, fees, or currency changes.
Chargebacks
You agree not to initiate a chargeback without first contacting us. Unauthorized chargebacks may be considered a breach of these Terms.
Attorney’s Fees & Collection Costs
In the event of a breach of these Terms, including unauthorized chargebacks, failure to pay, or fraudulent bookings, you agree to be responsible for reasonable costs incurred by Nova Travel Collective in enforcing these Terms, including attorney’s fees, court costs, and collection expenses, to the extent permitted by law.
6. Pricing, Currency & Promotions
Prices are dynamic and may change prior to confirmation due to Supplier updates, availability, or currency fluctuations. Promotions may be subject to additional terms.
7. Supplier Terms & Responsibility
All travel services are subject to Supplier terms. You agree to comply with all Supplier requirements. Failure to do so may result in cancellation, denial of services, or forfeiture of funds.
8. Changes, Cancellations & Refunds
Cancellations must be submitted in writing and may be subject to fees. Refunds are not guaranteed and depend on Supplier policies.
No refunds will be provided for unused services, including missed flights, late arrivals, or voluntary changes.
9. Travel Insurance
Travel insurance is strongly recommended. By declining coverage, you assume all financial risk associated with cancellations, delays, or disruptions.
10. Travel Documents, Entry Requirements & Admissibility
You are responsible for all travel documentation, including passports, visas, and health requirements.
Entry requirements may vary by destination and may include restrictions based on criminal history or legal matters. You are solely responsible for verifying admissibility.
Nova Travel Collective is not responsible for denied boarding, denied entry, deportation, or related costs.
11. Review of Travel Documents
You must review all travel documents upon receipt and notify us immediately of any errors. Failure to do so may result in additional costs.
12. Air Travel & Transportation Responsibility
Unless explicitly stated and coordinated in advance with your advisor, airfare and transportation to/from your destination are not included. You are responsible for arranging and managing these components.
13. Check-In & Travel Requirements
You are responsible for arriving on time, reconfirming flights, and complying with airline requirements. Failure to do so may result in loss of services.
14. Health, Fitness & Medical Responsibility
You are responsible for ensuring you are medically fit for travel and have obtained required vaccinations. We are not responsible for medical care or related costs.
15. Accessibility & Special Needs
Accessibility standards vary by destination. You are responsible for communicating special needs and understanding potential limitations.
16. Government Advisories & Safety
You are responsible for reviewing travel advisories issued by the U.S. State Department, CDC, and other authorities. We do not guarantee safety conditions.
17. Weather & Uncontrollable Conditions
We are not responsible for weather conditions or disruptions caused by natural events.
18. Itinerary Changes
Suppliers may modify schedules, accommodations, or activities at any time. These changes are outside our control.
19. Reliance on Information
Information on our website or provided by Suppliers may not always be accurate or current. You agree to verify important details independently.
20. Prohibited Uses
You agree not to misuse the website or attempt unauthorized access.
21. Intellectual Property
All website content is owned by Nova Travel Collective or its licensors and may not be used without permission.
22. Third-Party Links
We are not responsible for third-party websites or their content.
23. Assumption of Risk; Release; Covenant Not to Sue
Travel involves inherent risks. By booking, you assume these risks, release Nova Travel Collective from liability, and agree not to bring claims related to such risks.
24. Limitation of Liability
Nova Travel Collective is not liable for Supplier actions or travel disruptions.
Liability Cap
Our total liability shall not exceed the commissions or fees received by us.
25. Force Majeure
We are not responsible for delays or failures caused by events beyond our control.
26. Indemnification
You agree to indemnify and hold us harmless from claims arising from your actions or violation of these Terms.
27. Limitation on Time to File Claims
Any claim must be brought within one (1) year of the event.
28. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Nebraska.
29. Arbitration
At our discretion, disputes may be resolved through binding arbitration.
30. Class Action Waiver
You agree that any dispute resolution will be conducted only on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
31. Photo & Marketing Release
You grant permission for use of photos or videos for marketing purposes unless you opt out in writing prior to travel.
32. Fraudulent or Speculative Bookings
You agree not to make false, speculative, or fraudulent reservations.
33. Client Responsibility for All Costs
You are responsible for all travel-related costs, including taxes, fees, and additional expenses.
34. Modifications
We may update these Terms at any time.
35. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
36. No Waiver
Failure to enforce any part of these Terms does not waive our right to enforce them later.
37. Entire Agreement
These Terms, your booking confirmation, and our Privacy Policy constitute the entire agreement.
